URGENT LEGISLATIVE ALERT
Oregon Introduces Bill to Prohibit Sale of Aftermarket Parts

At the request of Governor Theodore Kulongoski, the Oregon Speaker of the House has introduced legislation (H.B. 2186) to prohibit the sale and distribution of aftermarket motor vehicle parts if alternatives are available that “decrease greenhouse gas emissions from motor vehicles.” The bill is primarily focused on aftermarket tires and would authorize the Environmental Quality Commission to implement enforcement regulations, likely based on a rolling resistance calculation.

We Urge You to Contact Oregon Speaker of the House Dave Hunt and Members of the Environment and Water Committee (Contact Information Below) Immediately to Request Their Opposition to H.B. 2186

* H.B. 2186 would regulate vehicle fuel economy, an authority reserved to the federal government.

* H.B. 2186 could ban tires that may have improved performance, handling or appearance features, based solely on a rolling resistance rating. In addition, this program could easily distract consumers from focusing on more important safety issues such as tire inflation and overloading of vehicles.

* H.B. 2186 would force consumers to purchase only original equipment manufacturer (OEM) tires because the program essentially exempts OEM-selected tires and unfairly implies that they are superior to aftermarket products.

* H.B. 2186 could prohibit aftermarket parts designed to either personalize or optimize specific vehicle performance attributes including handling, towing, suspension, fuel economy, etc.

* H.B. 2186 provides broad authority to government regulators and could limit a range of aftermarket parts currently available to consumers based on the subjective determination of government regulators.

Too bad nothing in this bill will make us any greener. I'd personally like to know how so many shitty ass cars can pass DEQ.

Hi,

I have received notice of some of the various subjects within this bill and take offense to a couple.

To attempt to ban tires based solely on rolling resistance is relegating citizen safety below mpg standards. Many people upgrade their tires so their car will handle and respond better, which is a safety issue. In general, OEM tires are all season and are not an optimal product.

Some cars come with multiple OEM tire options, is it really possible to keep a list of all of them and to have officers and DEQ officials checking sidewalls? In todays economy it also makes no sense to decrease the output of companies which could possibly lead to yet more layoffs.

That is also a possible result of limiting the sale of aftermarket products. This is the worst possible time to be limiting commerce.

I understand the current need to minimize fuel usage, which is why I drive a car that gets 38 mpg on the highway. To address this by hurting the economy is not a good plan. Maybe tax breaks should be applied to people who possess cars that get more than 30mpg hwy or drive hybrid cars (specifically, not trucks). People should be encouraged to carpool and live close to where they work.

And lets see, the state budget is short right now in Oregon, so lets spend taxpayer money on enforcing a law that bans items that make cars safer. What he really should be doing is banning studded tires.

I would be curious to hear how they plan to enforce it. They still rarely enforce cell phone laws and I think most of us have seen a cop on his cell phone while driving, I have seen a few.

Monmouth cops will pull you over for a "dim" license plate light and try to search your car.

Last time they tried I told them I don't care to waste my time humoring his curiousity if he did not have a reason to believe I was hiding something. I had a (1 pint) beer and a burger so he hassled me about DUII and let me go.

That'll suck if they 'ban' after market car parts. Be like parts of CA. I swear they pull you over for retarded shit as a reason to 'search' ur car for aftermarket parts such as intakes, exhaust, or your truck is too high, ur car is too low etc- its lame. Kind of funny though when a cop gets out a measuring tape to see if ur car is too high/low =}

That's why when I got pulled over in my old dropped S10 I pulled into a huge mud puddle :) Made him get his feet wet and when he stated with "I think your truck is to low..." BS I asked him to check my "scrub line" in the rear (I had just trimmed my ubolts ) he just let me go.
