Saying you're student is even better. And he is a student. As soon as I mentioned I was a student when I got parking tickets in Ontario, charges were dropped or cut in half.
Of course, your chances of winning anything in Montreal are slim to none... so don't get your hopes too high.

Alrighty so just had court.

I had found info of LIDAR Guns (laser detector or wtvr) where they all clearly indicate that they are only accurate to +/- 1 mph... which is exactly what I would of been arguing for.

Right before, the prosecutor came up to me and asked if I wanted to negotiate. So she said she was only "authorized" to drop it down to the closest bracket, but not any more than that. I didn't argue and took the deal. 1 less point and a smaller fine (i think i saved like 30$ plus admin fees, also have 3 months to pay the fine).

Thing is, she also explained to me that the "documents" i printed out - ie: the LIDAR gun specs - wouldn't be admissible as evidence, since there would have to be an expert to "validate" the info. Doesn't matter for this case, but hopefully, next month when I need to drop 4 km/h, the prosecutor isn't stuck up.

The judge can't credit partial points, either all or nothing (as the prosecutor stated). So now I'll need to come up with a compelling argument just in case for my next trial.

Last winter I was out and about one night before I went out to plow. Pulled into an near empty parking lot with the truck and started practicing my "evasive collision avoidance and vehicle control maneuvers" a passing officer saw me and lit me up in the parking lot. I figured OK he's just trying to scare me thinking I'm some dumb kid.

Negative ghost rider. He informed me it is illegal somehow. Ok so a warning should be sufficient here. Nope try again. I have a spotless driving record, even more spotless criminal record. Not a single mark on my name. To my dismay he comes back with a ticket for careless driving. 3 points and over two hundred bucks!!!! What in the actual fvck?!?! Of course I refused to accept that. I was on private property, not a soul was around and the only two cars in the well lit lot had a foot of snow on them indicating they hadn't moved in a week or more. All the businesses were closed. I'm not taking three points for doing nothing wrong. My jobs are at risk after that.


So off to the courthouse I went.

Walked in and the judge walks out in a button up plaid shirt and some nice Blue Jeans and boots. Alrighty. This is a plus.

The officer did show up to court as well with a much happier demeanor. I asked about the private property situation knowing that nothing can be cited unless someone calls in and complains and nobody was around. Judge said that the officer witnessed what I was doing and that legally counts as a complaint. I wasn't in a mood to argue too much since I had two jobs on the line if I couldn't get this ordeal toned down a bunch. As wrong as this is I just lived with it. I can do what I want on private property. Oh well.

So I explained that I hold a CDL and have a job that requires me to retain that and keep a clean record to stay working. Plus I have a second job plowing that requires a clean driving record. I guess that was the ticket to my salvation (no pun Intended). I also made it clear that I had a spotless driving and criminal record and asked the officer to confirm this which he did.

On that note the judge basically said that the ticket was a bit overboard for who I am and what I was doing and my record. He knocked all the points and dropped it to an impeding traffic (basically like if you broke down in the road or were going 15 or more under the speed limit and slowing traffic) which is no points (insurance never sees it) and $100 cash to which I happily obliged to paying. I showed up with all the cash just in case I wasn't so lucky. I gladly paid the court to shred the ticket and forget it all happened.

Never been pulled over by a cop..... For one red light camera ticket, 13 over, $250. Payed it. No points. One accident though, so I'm at 0 right now.
